Nevertheless, if legal actions are unavoidable, we have the experience and competence to ensure that our customers are adequately represented throughout the process.
A rise in the use of alternative dispute resolution (ADR) methods, particularly mediation, as a way of resolving conflicts has been observed as a result of the Civil Justice Reform conducted by Vietnam Judiciary over the past ten years. Using practical, cost-effective, and less confrontational methods of mediated settlement negotiations, we at GVLAWYERS believe that we may achieve significant benefits. Several of our practitioners have received accreditation as mediators, making them fully competent of being separately instructed to conduct such mediations on behalf of parties in dispute in their own right.
We have a diversified litigation and dispute resolutions legal practice. Our professional services include legal advice and legal representations to our clients in Vietnam courts: civil litigation for various reasons (commercial agreements, shareholders arguments, trade debts, assets’ rights, probate or will) and divorce proceedings.
According to Article 9 of the 2015 Civil Procedure Code, litigants have the right to defend themselves or have lawyers protect their legitimate rights and interests. When lawyers participate in civil cases, they will contribute to protecting the legitimate rights and interests of the involved parties, collecting and handing documents and evidence, debating, answering and applying laws to protect their rights and interests or refute others’ requests.
Foreign lawyers practicing in Vietnam may give advices on foreign law and international law, may provide other legal services relating to foreign law, may give advices on Vietnam’s law if they have a bachelor’s degree in law of Vietnam and satisfy the requirements applicable to Vietnamese lawyers; may not participate in proceedings as representatives, advocates, protectors of the lawful rights and interests of litigants before Vietnamese courts.
