Global Vietnam Lawyers respectfully introduces the event series VAS 2023 Crossover – Discussion series on issues that need to be amended and supplemented in the 2010 Law on Commercial Arbitration and the VIAC Arbitration Rules.Topic 05: Conducting arbitration proceedings
Regulations on conducting arbitration proceedings play an important role in the dispute resolution process by arbitration, to ensure fairness for the parties as well as promote an effective resolution process. Currently, besides regulations on procedural issues such as arbitration language, arbitration location, applicable law, Vietnamese law currently has no specific regulations on the authority to administer arbitration proceedings nor as the authority to evaluate evidence.
This creates difficulties for the arbitral tribunal during the arbitration proceedings. The fifth Talkshow in the series of events “Discussion on issues that need to be amended and supplemented in the 2010 Commercial Arbitration Law and VIAC Arbitration Rules,” was held to discuss the topic “Conducting arbitration proceedings.” Arbitration”, discussing proposals in the draft amendments to the Arbitration Law 2010 of the Vietnam Bar Association and comparing with the provisions of the Model Law and UNCITRAL Arbitration Rules including: arbitration language, Arbitration location, applicable law, etc.
